Eligibility: Individuals who reside in the fifty (50) United States or the District of Columbia and who are 18 years of age or older are eligible to enter. A winner must claim his or her prize by February 20, 2022, by 5:00 pm or the prize will be forfeited. This giveaway is void where prohibited and is subject to all local, state, and Federal laws. By entering, each entrant accepts and agrees to be bound by these promotion rules. All times herein are Eastern time zone.

Sponsors: The sponsor is Dominique NeSmith, of Sneads Ferry, NC. Sponsor will conduct the giveaway as described in these official rules.

Agreement to Rules: By entering the Super Bowl 2022 Prediction Gift Card Giveaway, the Entrant (“You”) agrees to abide by the Sponsor's Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserve the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this Super Bowl 2022 Prediction Gift Card Giveaway represents and warrants that You are eligible to participate based on eligibility requirements explained in the Official Rules. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this Super Bowl 2022 Prediction Gift Card Giveaway.

Promotion Period: This promotion begins on February 6, 2022 at 12:00 PM Eastern Daylight Time and ends on February 13, 2022 at 6:00 PM Eastern Daylight Time. To be eligible for the Super Bowl 2022 Prediction Gift Card Giveaway, entries must be received within the specified Entry Period.

How to Enter: Beginning at 12:00 PM Eastern Daylight Time on February 6, 2022, individuals go to https://www.realtordominique.com/superbowl and complete the entry form. Entries must be received by 6:00 PM Eastern Daylight Time on February 13, 2022, in order to qualify. Additional Facebook entries will be deemed made by the authorized account holder of the Facebook account used to submit the entry at the time of entry. The authorized account holder is the natural person who is assigned to the Facebook account by Facebook. Multiple entrants are not permitted to share the same Facebook account. Entries submitted will not be acknowledged or returned. The contest/sweepstakes administrator’s computer is the official time-keeping device for the Promotion. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, NFL, AFC, Cincinnati Bengals, Los Angeles Rams, Amazon, or any of their affiliates. By submission of an entry, an entrant releases Facebook from any responsibility or liability for the Promotion’s administration, prizes or promotion. You are providing entry information to Dominique NeSmith and not to Facebook.

Prize: One (1) gift card to Amazon.com in the amount of $50 U.S. Dollars will be delivered via e-mail to the winner.

Odds of Winning: Odds of winning depend on the total number of eligible entries received.

How the Prize will be Awarded: A winner will be picked randomly from the entry forms submitted through https://www.realtordominique.com/superbowl and Facebook or Instagram posts created using #RealtorDominique. Winner will be notified via email.

Rights Granted by the Entrant: By submitting an entry into Super Bowl 2022 Prediction Gift Card Giveaway, You understand and agree that the Sponsor, any individual acting on the Sponsor’s behalf, and the licensees successors, and assigns of the Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, your submission, name, photo, portrait, voice, likeness, image, statements about the Super Bowl 2022 Prediction Gift Card Giveaway, and your biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration.

Terms & Conditions: In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the Super Bowl 2022 Prediction Gift Card Giveaway should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor’s control, impact or corrupt the security, fairness, proper conduct, or administration of the Super Bowl 2022 Prediction Gift Card Giveaway. The Sponsor, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the Super Bowl 2022 Prediction Gift Card Giveaway or website or violates these Terms & Conditions will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the Super Bowl 2022 Prediction Gift Card Giveaway, to void votes for any reason, including, but not limited to: the use of bots, macros, scripts, or other technical means for entering Attempts by any entrant to deliberately damage any website or undermine the legitimate operation of the Super Bowl 2022 Prediction Gift Card Giveaway may be a violation of criminal and civil laws. If any such attempt is made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.

Limitation of Liability: Your entry into this contest constitutes Your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the contest and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.

Disputes: Except where prohibited, by participating in this Promotion, entrants agree that: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant(s) and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of North Carolina without giving effect to any principles of conflicts of law of any jurisdiction. Entrant agrees that any action at law or in equity arising out of or relating to this Promotion, or awarding of the prizes, shall be filed only in the state or federal courts located in Onslow County, North Carolina and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Promotion, each entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Promotion but in no event attorneys’ fees; and (c) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
